Terms of Participation

Please read Body Mind as One's latest Covid-19 Statement, as certain aspects of the general Terms of Participation are affected.

These Terms of Participation relate to Body Mind as One Services namely Group Classes, Workshops, Events and Private Classes, that are instructed, led or hosted by Janet Drake T/A Body Mind as One.

These Terms of Participation, along with Terms & Conditions and Privacy Policy collectively form Body Mind as One's Terms of Use

​

Please read these Terms of Participation carefully as they relate to the booking of, pre-payment for, and participation in any Body Mind as One Services.

​

These Terms of Participation form part of Body Mind as One’s Service Registration, by agreeing to the declaration on the Client Registration Form you are agreeing to these the "Terms of Participation".

​

These Terms of Participation are subject to amendment from time to time, the latest edition will be denoted by the date at the foot of this document.

​

Disclaimers regarding participation in Body Mind as One Services.

The client, alone, knows their own body and mind and as such taking part in any Service should be performed at a level and pace that feels right and comfortable for the client.

  • It is the client’s responsibility to inform the Janet Drake immediately should they feel pain or discomfort during participation in a service.

  • It is the client’s responsibility to inform Janet Drake, prior to participating in a Service, if their health or ability has changed since booking a Service.

 

Body Mind as One cannot be held liable for any personal injury relating to a client’s participation in a Service, especially if:

  • The client’s medical practitioner has, on health grounds, advised against taking part in a Service.

  • The client is taking prescribed medication that advises against taking exercise, driving, and/or other similar activities.

  • The client fails to observe, follow and apply the instructions and cues on safety and technique during a Service.

  • Should any injury be caused by the negligence of fellow client during the participation of a Body Mind as One Service.

  • Should any injury be caused by the client being under the influence of any illegal substances, alcohol or after eating a heavy meal.

 

1. Services

  • Availability

Services are subject to availability.  Body Mind as One will always do their utmost to provide booked and prepaid for Service.

Non-availability of any Service may be subject to changes outside of Body Mind as One’s control, such as:

  • Changes to the Online Platform used or Venue accessibility or availability

  • Insufficient client bookings to justify holding the Service

Where possible, & if appropriate, an alternative Service may be provided.

 

  • Service Cancellations

Clients will be informed of any changes to their Service by email or text at the earliest possible time.

 

Clients are advised to subscribe to receive Body Mind as One's eMails and eNews, the link is found at the bottom of every webpage.

2. Service Fees

Body Mind as One may increase Service fees at any time. Clients will be informed not less than 14 days prior to any such increases.

​

3. Booking and Prepayments

All Services must be pre-booked and pre-paid.

  • Service Booking are open 30 days in advance (unless otherwise stipulated)

  • Service Bookings are closed 12 hours before the start time of the service

 

Bookings are made via the website

​

Pre-Payment Methods:

  • Debit or Credit Card via Stripe, or

  • Bank Transfer

 

No contract will exist in relation to Service Bookings until Body Mind as One has confirmed by email the particulars of the booking including the Service details and fee paid.

  • Refunds

Body Mind as One adheres to a strict “No Refund” policy for Service fees.

A refund will only be provided if Body Mind as One cancels and there is no alternative service available.

 

  • Rescheduling a booking

You may move your booking to an alternative Service of the same fee value, providing there is space, and you do so within:

  • 1 calendar month from the date payment was received by Body Mind as One, and

  • 24 hours before the start time of the selected alternative Service

If you do so after the above then you will forfeit the fee paid.

 

  • Cancelling a booking

You may cancel your booking.

Refund of service fees will not be provided (see Refunds above)

 

  • Passing Over a Booking

Clients may pass over a booking but only with express permission from janet@bodymindasone.com

 

4. Service Attendance

The following conditions are stated out of respect and consideration for the teacher and fellow clients

  • Attendance: minimum & maximums

Due to the nature of the services provided by Body Mind as One’s and for client safety the following Service minimum & maximum numbers are:

​

121: 1 minimum 1 maximum

Body Mind as One Classes: 6 maximum

Events & Workshops: Advised accordingly

 

5. Service Timeliness

All Service will start on time, lateness will not be tolerated.

The Studio door may be locked once the Service has started.

Online Sessions will be locked once all attendees have been admitted or 5 minutes after the start time, whichever is sooner.

6. Safety & Security

  • The Studio

    • Clients are advised not to bring valuables into the studio

    • All outdoor footwear is to be removed, left in the cloaks & shoe area within the entrance of the Studio.

    • No shoes are to be worn in the practice area

    • Only items that will be used by the client during the service are allowed in the practice area

    • No crockery, glass or anything breakable is permitted in the practice area

    • No food is to be consumed within the practice area

    • Water in a spill proof bottle is allowed in the practice area

    • Mobile devices, including phones, must be switched to "Do Not Disturb" or "Off" during practice

    • Any fitness devices maybe used but only in silent mode

 

  • Online

    • Clients are advised to ensure that their practice area is clear of all obstacles that may cause harm or injury

    • No food is to be consumed while practicing

    • Water in a spill proof bottle

    • Mobile devices, including phones, must be switched to "Do Not Disturb" or "Off" during practice

    • Any fitness devices maybe used but only in silent mode

    • Other members of the household should be persuaded to be respectful of your practice time and space, including limiting their own use of the internet

 

7. Cleanliness

  • The Studio

    • If clients have verrucae or similar foot complaints, please ensure that you have appropriate foot covering to avoid spreading or worsening the condition.

    • Ensure that hands are thoroughly washed and dried before using any of the equipment or props

    • Clients are requested that their bodies, clothing and personal equipment smell neutral, i.e. no strong body odours or perfumes / deodorants

 

8. Clothing & Footwear​

  • Clients are advised to wear clothing:

    • that preserves their dignity throughout the full range of movement

    • allows for body alignment to be visible, for guidance and adjustment purposes

    • that do not require belts or zips or buttons, etc. that may cause restriction, discomfort or pain during practice

  • Clients are advised to be in bare feet or wear non-slip socks 

 

9. Equipment

  • Venue

    • Body Mind as One will provide yoga mats, yoga blocks and exercise bands – all are regularly cleaned.

    • Clients will be required to bring additional props / aids as advised before joining the Service

    • Clients are permitted to bring their own equipment, but must arrive early for their Service in order to set up

    • Clients may use suitable towel or travel yoga mat to cover the yoga mat.

10. Client Communication

It is the client’s responsibility to supply Body Mind as One with their valid and correct information on the Client Registration form

Should there be any changes to the information supplied then the Client must inform Body Mind as One of the changes.

 

  • eMails

Body Mind as One will provide Service Information and Updates via email.

 

Spam / Junk Emails: please ensure that you have added janet@bodymindasone.com to your email account address book to avoid emails moving into Junk or Spam folders.  Certain email providers have, by default, other folders such as Promotions, etc. in which Body Mind as One eMails may be delivered, therefore it is advised to check these before contacting Body Mind as One if you are not receiving expecting information.

Body Mind as One will telephone or send texts to clients in relation to their Service should it be necessary.
